Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (the business or business owner using the service, “you”, “your”) and PublishMyReviews (“PublishMyReviews”, “we”, “us”, “our”) for the use of the QR review collection, AI polishing, and Instagram publishing platform available at publishmyreviews.com and the related applications (the “Service”).

By creating an account, paying a subscription, or using any part of the Service, you accept these Terms along with our Privacy Policy and Refund & Cancellation Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and competent to enter into a contract under the Indian Contract Act, 1872. You confirm that you are using the Service in the course of a lawful business and that you are authorised to act on behalf of that business.

You are responsible for maintaining the confidentiality of your login credentials and for everything that happens under your account. Notify us immediately at support@publishmyreviews.com if you suspect any unauthorised access.

The Service helps you:

• Generate a single business QR code that opens a hosted review form for your customers.
• Collect reviews, optional photos, and Instagram handles from customers, with an explicit consent flag.
• Optionally polish a customer’s review text using AI (Google Gemini) at the customer’s request.
• Render testimonial graphics and publish approved testimonials to your connected Instagram Business account.
• View basic analytics about scans, reviews, and posts.

Specific features available to you depend on your subscription tier and any add-on purchases. Plan inclusions are listed on the pricing page and inside the application under Settings › Billing.

Plans are billed in Indian Rupees (INR) on a monthly or annual basis, as selected at checkout. All listed prices are inclusive — no additional taxes are added at checkout.

• Payments are processed by Razorpay Software Pvt. Ltd. We never see or store your full card number, CVV, or UPI PIN.
• Subscriptions auto-renew at the end of each billing cycle, subject to applicable RBI rules on recurring payments. For amounts above the regulator-prescribed cap (currently ₹15,000 per transaction) we will ask for explicit re-authorisation before charging.
• You can cancel any time from Settings › Billing. Cancellation stops the next renewal; access continues until the end of the current paid cycle.
• Refunds are governed by our Refund & Cancellation Policy.
• If a payment fails we will retry on the standard provider schedule. After 7 days of unrecovered payment your account is moved to read-only mode until you settle the outstanding invoice.

Each plan has monthly limits for AI polishes, Instagram publishes, templates, and reviews. Limits reset on your billing anniversary. When you exceed a limit you can either upgrade your plan or buy an add-on top-up; add-on credits stack on top of your plan’s monthly quota and expire at the end of the current billing cycle.

You agree to use the Service only for legitimate testimonial collection. You will not:

• Submit, generate, or publish reviews that are fabricated, paid-for, incentivised, or that the customer has not actually given.
• Pressure, mislead, or trick customers into giving a review or a particular rating.
• Publish a customer’s name, photo, or words without first having their genuine consent — whether captured digitally through our form or recorded by you using the “consent recorded” option.
• Use the Service to defame any third party, harass any person, or infringe anyone’s intellectual property or privacy rights.
• Use the Service for content that is unlawful, obscene, indecent, or otherwise inappropriate under Indian law.
• Probe, scrape, or attempt to bypass the Service’s authentication, rate limits, or security controls.
• Resell, sublicense, or white-label the Service without our prior written agreement.

We may suspend or terminate your account immediately if we have reasonable grounds to believe you are violating this section. We may also remove specific content that violates this section without prior notice.

Reviews collected through the Service belong to the customer who wrote them, but you retain a non-exclusive right to display them in line with the consent the customer provided. By using the Service you confirm that:

• Customer consent is genuine, informed, and obtained before publishing.
• You will honour any later request from a customer to remove their review or photo within a reasonable time.
• You are the data fiduciary for the customer review data; PublishMyReviews acts as your data processor as described in the Privacy Policy.

The Service offers an AI “polish” feature that rewrites a review for clarity. The AI output is generated by a third-party model (Google Gemini) and may occasionally produce inaccurate, awkward, or unintended phrasing.

• The customer is shown both the original and the polished version and chooses which to submit.
• You are responsible for reviewing what gets published. PublishMyReviews does not guarantee the accuracy, tone, or appropriateness of any AI-generated text.
• You will not use the AI feature to fabricate reviews or alter the substance of what a customer actually said.

The Service integrates with Google’s Places API and Meta’s Instagram Graph API. You separately agree to the terms of service of those platforms when you connect your accounts:

• Google Maps Platform Terms of Service and the Google Maps / Google Earth Additional Terms of Service.
• Instagram Platform Policy and the Meta Platform Terms.

We follow the published policies of these platforms. We do not auto-post on your behalf without your explicit action, we do not send customers fabricated review templates to copy into Google, and we do not incentivise ratings. If a third-party platform changes its rules in a way that affects the Service, we will adapt as quickly as we can but cannot guarantee uninterrupted integration.

The Service, including all software, design, copy, graphics, AI prompts, and brand assets, is the intellectual property of PublishMyReviews. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for the duration of your subscription and only for your business.

You retain ownership of the content you upload (logos, photos, business information). By uploading content to the Service you grant us a worldwide, royalty-free licence to host, store, render, and display that content for the sole purpose of operating the Service for you.

We work hard to keep the Service running reliably but do not currently offer a contractual uptime SLA. Scheduled maintenance, third-party outages (Google, Meta, Razorpay, hosting providers), and force-majeure events may temporarily affect availability. We will use reasonable efforts to communicate planned downtime in advance.

You may cancel at any time from Settings › Billing.

We may suspend or terminate your account if:

• You materially breach these Terms or the Acceptable Use clause and fail to cure the breach within 7 days of notice (where curable).
• You do not pay an outstanding invoice within 14 days of notice.
• We are required to do so by law, court order, or instructions from a regulator.

On termination your access ends, but customer reviews and other content you exported before termination remain yours. We may retain a minimal record of the account for legal, accounting, and audit purposes as described in the Privacy Policy.

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fully secure.

To the maximum extent permitted by law, PublishMyReviews is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, however arising.

Our aggregate liability arising out of or relating to the Service in any 12-month period is limited to the fees you actually paid to PublishMyReviews in the 12 months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under Indian law.

You will defend and indemnify PublishMyReviews and its officers, employees, and contractors from and against any third-party claim arising from (a) your breach of these Terms, (b) your violation of any law or third-party right, (c) any content you publish through the Service, or (d) any claim that a customer review you published was not consented to.

These Terms are governed by the laws of India. The courts at Kurukshetra, Haryana have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any consumer-law rights you have under the Consumer Protection Act, 2019.

We may update these Terms as the product, the law, or our third-party processors change. Material changes will be notified to the registered owner email at least 7 days before they take effect. The “Last updated” date at the top of this page always reflects the current version. Continued use of the Service after that date constitutes acceptance.
